On September 4, 2001, he was named as the Director of the Federal Bureau of Investigation.

On March 10, 2004, he and Deputy Atty. Gen. James B. Comey visited Atty. Gen. John Ashcroft in the hospital, to urge him to resist pressure to approve a warrantless eavesdropping program targeting U.S. citizens.
